What to expect from final inspection to moving in

1. Pre-Handover Inspection Invitation
Once your home is ready, you’ll be contacted to schedule your pre-handover inspection appointment.
At this stage:
- Final construction is complete
- Your unit is prepared for inspection
- A suitable date is arranged for your visit
2. Pre-Handover Preparation (Behind the Scenes)
Before you arrive, Leogem ensures:
- All finishes and installations are completed
- Appliances, fittings, and services are tested
- The home is professionally cleaned and prepared
3. Pre-Handover Inspection (Your Walkthrough)
You’ll attend a pre-handover inspection at your property and will be welcomed by a Leogem representative.
During this walkthrough:
- You inspect the full unit
- All key systems are tested
- Any visible issues are identified
4. Pre-Inspection Form
If anything needs attention, it’s recorded on the pre-inspection form.
This includes:
- Minor finishing items
- Adjustments or touch-ups
- Any items that require correction
5. Post Pre-Inspection Process
Once the pre-inspection has been completed:
- Any items identified during the inspection will be attended to and rectified by the contractor.
- Upon completion of all necessary works, a handover appointment will be scheduled with you.
6. Handover
At the handover appointment:
- We will walk through the property with you to confirm that all items identified during the pre-inspection have been addressed.
- You will be introduced to the managing agent and the relevant parties responsible for the estate or development.
- The handover documentation, including the Handover Certificate and Handover Checklist, will be reviewed and signed.
- Once this process is complete, the property will be formally handed over to you.
7. Post-Handover: 90-Day Snagging Period
After handover:
- Your 90-day snagging period as per NHBRC applies from here on.
- Any valid snag items reported during this period will be reviewed and attended to accordingly.
- From the date of handover, full responsibility for the maintenance and care of the property passes to you as the homeowner.
TERMS & CONDITIONS – HANDOVER
1. Introduction
1.1 Leogem Property Projects (Pty) Ltd (Registration Number: 1992/003579/07) (“Leogem”) is a turnkey property developer delivering residential and commercial developments across South Africa.
1.2 These Terms and Conditions govern the relationship between Leogem and the purchaser (“the Purchaser”) in respect of the handover of any residential property developed by Leogem, including the identification and rectification of minor defects during the defined snagging period.
2. Definitions
Unless the context indicates otherwise:
- “Applicable Laws” means all relevant South African laws, regulations, by-laws, and statutory requirements.
- “Property” means the residential unit purchased by the Purchaser, including all improvements, fixtures, and fittings.
- “Handover Date” means the date on which the Purchaser receives keys and takes possession of the Property.
- “Handover Inspection” means the joint inspection conducted prior to or on the Handover Date.
- “Snag List” means the list of visible defects recorded during the Handover Inspection.
- “Snag Period” means the period after handover during which agreed defects may be addressed by Leogem.
3. Applicability
3.1 These Terms apply to all residential properties developed by Leogem Property Projects in South Africa.
3.2 These Terms must be read together with:
- The Agreement of Sale
- The Handover Checklist (Annexure A)
3.3 In the event of any conflict, the Agreement of Sale shall take precedence.
4. Handover Process
4.1 A joint inspection of the Property will be conducted between Leogem and the Purchaser on the scheduled handover date.
4.2 During this inspection:
- The Property will be assessed for visible defects
- A Snag List will be compiled and agreed upon
4.3 Upon completion of the inspection:
- The Purchaser will sign the Handover Checklist
- The Property will be deemed accepted, subject only to recorded snag items
5. Snagging & Defects
5.1 Only defects recorded on the Snag List at the time of the Handover Inspection will be considered for rectification.
5.2 Leogem will address all reasonable snag items within a reasonable timeframe, taking into account:
- Contractor availability
- Nature of the defect
5.3 The following will not be considered defects:
- Minor cosmetic variations
- Natural material characteristics
- Wear and tear occurring after handover
- Damage caused by the Purchaser or third parties
5.4 Any additional defects identified after handover must be reported within the Snag Period and will be assessed at Leogem’s discretion.
6. Purchaser Acknowledgements
The Purchaser acknowledges that:
6.1 The Property is sold subject to:
- Title deed conditions
- Applicable zoning and municipal regulations
6.2 The Property is accepted voetstoots (as is), subject only to defects recorded in the Snag List.
6.3 Risk in the Property transfers to the Purchaser upon registration and/or handover (whichever applies in terms of the Agreement of Sale).
6.4 Leogem shall not be liable for:
- Damage caused by third-party contractors appointed by the Purchaser
- Any use of the Property not aligned with its intended purpose
7. Risk & Liability
7.1 From the Handover Date, the Purchaser assumes full responsibility for:
- Maintenance
- Security
- Insurance
7.2 Neither Leogem nor its directors, employees, or agents shall be liable for:
- Loss, damage, injury, or death
- Damage to property or belongings
Except where liability cannot be excluded under applicable law.
8. Purchaser Responsibilities
The Purchaser agrees to:
8.1 Maintain the Property in good condition after handover
8.2 Allow reasonable access to Leogem or its contractors to complete snag repairs
8.3 Not interfere with or attempt to repair defects without written approval
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
The Purchaser consents to the jurisdiction of the relevant South African courts for any disputes arising from these Terms.
10. Amendments
Leogem reserves the right to amend these Terms where necessary, subject to applicable law.
